I request a change of venue before the police writes up the traffic ticket. He refused. I requested again. He refused. He went ahead and write it to his convenience.

It's a request, he can deny it if he chooses to.

I have never even heard of an officer having the authority to change venue. Departments and the courts normally have arrangements to even out the case loads in the courts.

Venue is the court responsible for the jurisdiction where the offense occurred. The officer is required by law to issue the citation to the court of venue.



The police officer has no authority to change the venue. That is done by a judge, not a police officer. You must petition the court and give good reason why you could not get a fair trial in the venue of the offense.

A change of venue means that your case will be moved to another jurisdiction for trial. The officer was correct he has no authority to change in which court you will appear. To get a change f venue you will have to demonstrate to the court that you will be unable to get a fair hearing in that court. Your chances of getting the change are very slim.

The only time he can approve a change of venue if it is in the best interest of the officer and the agency.



i.e it would save them money in the prosecution or time
