Question:
He punched me in the face, It's a simple assault charge...Will he do any time? 10 pts easy?

Okay, my ex fiancee whom I have an 8 month old with punched me in the face 3 times...he was picked up and did 5 days in jail released on 1500 bail. I had to go to the hospital, closed head injury. We have court on Wednesday for this matter on wednesday and I wanted to know if he can do actual jail time for this matter? It's in the state of NJ...He also filed a counter complaint stating that I hit him...which I did not...he has no marks, pictures....anything and he didn't file that complaint until like a week after he was released. He changed his statement 3 times the first stating that he admitted to hitting me, the second saying I hit him once and he didn't hit me, the third stating I hit him twice.

He is 6'0 and I am like 5'6 he is 200 lbs and I am like 110. He also has a pending sexual assault charge on top of this.

Will he do time for the simple assault or do they just slap him on the wrist??? Any help I would really appreciate it!!

If it is his first offense and he has no record it is unlikely that he will do any time other than what he already served.



If he has a history of this and other criminal acts, (such as the sexual assault) he could do some time depending on the Judge and his attorney.



My advice is to get a restraining order and only have needed contact with him regarding your child. Other than that leave him alone.

There are many factors that must be considered before a sentence is imposed. These would included you're boyfriend's criminal history, the severity of injury and what crime and to what degree your boyfriend pleads guilty to or is found guilty. He could do jail time either county or state. He could get probation. He could also only get a fine if the assault is reduced to a summary offense. The jude would impose a sentence. Sentencing is based on the aforementioned factors in addition to sentencing guidelines and recommendations from the prosecutor. He could be found guilty and they could give him time served for the 5 days he spent in jail which means he wouldn't do any additional time.

I'm from Canada and sentence's differ it seem's.

He sound's just like a X-friend I've tried to understand and justify his arrogance for year's but have given up on him. You should get criminal Compensation. Look into it. You should wwin. Even if he get's convicted and a slap on the wrist's you might feel better if you get compensated. I won first prize in a fight the fellow above stated. First,he stated it.Lyed,got 4 moth's and I got $2,400.00.

The judge will probably make an example out of the issue and give him time.

he probably won't do any time but the judge may require him to enter a violent offender's program and keep away from you. in the meantime, don't accept any calls from him, IMs or emails. it will only send him the wrong signal.

Yeah, he'll definitely serve time (probably not that much though), and come out meaner than he went in, so be careful!!
