I recently got a battery ticket that I am not guilty of. My public defender is currently working on dropping the charges. It is a family matter and I was told the case would be dropped. If not, my plea bargain would be just to do community service and the charges would be dropped. I have court coming up in a month, however when applying at sprint they denied my employment because I have an upcoming court date. Since I am not guilty until proven so, is this right? Should I fight this or just drop it? I just don't feel like my future should suffer over something I am not even guilty of, seems very unfair. Please let me know!

If you plea to get community service, then the charge is not dropped...it may be expunged. You can be denied employment for almost any reason. Life is not always fair.

Legally they cannot consider you as criminal unless court descision says so. If the case is pending then you are common man just like anybody.

Also it depends which employment you are taking of ? In private companies they can deny employment citing any reason for e.g non-efficiency, He/She does not bring good profit to us, We follow bell-curve method hence your other guys are superior than you etc..... (they need not wait for court orders).

Unless you told them about it, it doesn't go on your record until after you're convicted. The police will always have a record of it, regardless if it's dropped or not and expunged later. But, that information won't be available to the public.

They do not have to hire you. They do not even have to give you a reason. They have the right to refuse because of upcoming court dates.

You can be denied employment if someone doesn't like your hair style hun.
