I was driving down a residential road when a child on a bike came in the road.I swerved out of the way from hitting the child but still had enough time to come to a screeching halt to stop at the stop sign.There was an officer at that intersection who even after seeing everything proceeded to pull me over. He came my car after running my plates and said is everything ok and said I will let you go for the stop sign ticket.Walked back to his car to find out my liscence was suspended. long story short..a previous ticket had been mistakenly entered twice by the police department.Due to the second ticket(the mistake)my license was suspended.Anyways the officer arrested me for driving on a suspended license and still wrote me the stop sign ticket. Now I am in the middle of getting the mistake ticket vacated.Very frustrating due to the fact nobody wants to admit they made a mistake.In the end after everything,will the stop sign ticket and the driving on a susp. ticket hold up??

Yeah, where I live here in the lame@ss State of Arkansas that is just one of the games the p!g@ss cops play here. Another one is they will accept your fine money and then never enter it in the computer that you paid. Then they get a warrent for failure to pay. If you throw away, lose or something else happens to your reciept and you did not pay with a check (most departments are going to cash only) you are sh!t outta luck. Your going to jail and get to pay again. This just recently happened to a friend of mine to the tune of $1,200 on something that he paid and had cleared up 12 years ago. this also happened to my neighbor. He was making payments on a fine and payed it off. The next time the nazi's set up there regular road block he had a failure to pay his last payment. He went to jail 'til his wife showed up with the reciept. Sorry but I don't know what you can do to fight the system legally. It is a regular raquett they run here. I am from California originally and used to have the highest respect for law enforcement there. I don't have any here though except for The Arkansas State Troopers. They're a class act. I HATE small county and city law enforcement in this state.

No, when the court sees that youre license should've never been suspended in the first place, the Judge should throw out the suspended license ticket. As for the stop sign, I'm not really sure about that.. Ive learned if you just be straight up about it and tell the truth (i.e. I was trying to avoid hitting a KID) .. they'll be more leniant (sp)... if you can, obtain a copy of the original ticket that was entered into the system twice, and show that you paid it, or whatever you did to get it taken care of.

you challange the driving suspended charge if you prove the ticket that caused the suspension was in error.



I dont understand the stop sign ticket if you actually stopped, and the incident with the kid on the bike should work in your favor.

Stop sign yes, suspended license yes unless you can prove on paper it was a clerical error on their part. Have to have all the records in your hand for the traffic court judge.

It'll get all thrown out of court if your license was mistakenly suspended. I'd get a lawyer and countersuit the charges and expenses, that'd definitely get it thrown out of court. Plus you wouldn't have to pay any fees.
