Im gonna get my license taken away because of this party? im so confused!?

So i was at a party like 2 weeks ago. and im 16 and the cops showed up cause someone called 911 from the house for some reason.

and i had to get picked up from my parents. i wasnt drunk or drinking cause i was sick and i was on tylenol.

but now i have a court date for it cause i was there and had to get picked up along with 25 other people. and supposbly 26 kids including me are getting there license suspended for 1-2 years.

can you explain what i can do so that wont happen? or why is this even happening? they have no proof of anything. will i still get my license taken away

You don't tell us what you were charged with....minor in possession of alcohol? Zero tolerance laws? There is nothing you can do to prevent losing your license. You should not have been there is the first place. Many states have laws that if you are a minor and have access to alcohol you can be charged with possession, it doesn't have to be in your hand. Obviously they have probable cause and the prosecuting attorneys feel like they have enough evidence to prosecute you. You should have made better choices.

I'll make a few educated guesses here. There was alcohol at the party, some people at the party drank a lot, the police came in response to a 911 hangup call or an inappropriate call to 911.



When the police arrived the alcohol was in plain site. The officers have all they need to charge everyone at the party with something ... minors in possession for those under 21, contributing to the delinquency of minors and providing alcohol to minors for the over 21 crowd.



You are basically in very deep trouble! the minor in possession charge will stick like glue to every minor at the party, the judge can (and probably will) suspend all of your driving privileges for a while.



I don't like this particular law, I saw nothing wrong with drinking at 18. The law is the law, like it or not you are busted.

You actually have two issues: 1) the criminal charge against you and, 2) the license issue.



CRIMINAL:

At your Arraignment, you will hear what formal charges the State is bringing against you, if any.



The State has the burden to prove the crime beyond and to the exclusion of every reasonable doubt. If you are telling the truth about not drinking and not being drunk, then you have not committed a crime and therefore have nothing to worry about.



LICENSE:

You do not have a right to drive like you have a right to have the State prove its case against you. Driving is a privilege. If you are convicted of any crime and/or municipal ordinace, youor license could very well be suspended.



My advice to you: Stop looking for free advice and call a lawyer in your area. For now, you are safe, but it will get worse (for you) before it gets better.

Get a lawyer. In GA, if an underage person is caught drinking, then their license is suspended for one to two years or until the age of 21. It sounds like they are automatically assuming everyone was drinking.
