ticket in school zone when not marked properly?

We live on a street that his a school zone certain times of the day. The speed limit is 25 usually but certain times of the day it is 20. My husband was going 30 on the road and got a ticket for going 10 over in a school zone. He usually goes to work at 5am and doesnt come home until 6pm so he is never driving down the street during school zone time. He had to be at work at 7am one morning so he left our house later then usual. our house is in the school zone so when traveling down the road you are already past the sign so you dont see an actual sign upon leaving our house. There is no time listed on any of the signs in any direction so he has never known the actual time the road is a school zone. And the sign that does say school zone when light is flashing is actually mostly blocked by a tree so you cant even see the flash. He is going to court later today to fight it. He thinks he will win that the school zone is not marked well enough because it really isnt. But can they then give him a new ticket for going 5 over the speed limit or once the ticket is written for going 10 over in school zone they can not change it.

If it's not to late, you should take pictures of the tree covering the sign to show to the judge. Also, cite the time the ticket was given and the time the school zone restriction actually begins.

What the others say about not knowing since you live there is both right and wrong. Ignorance can't be used as a defense, but just living there doesn't mean you know everything there is to know about a place. Did you know you can get a ticket for going 21 mph in a 20 mph school zone? Most people don't, yet they drive through school zones all the time. Ignore people that chastise you in an answer instead of helping. :)

Cops give out tickets to fill a quota. Sometimes, you get the cop that reduces the charge. Oftentimes, you get the cop that's gonna try to hit you with everything (s)he can.

If you live in the school zone there is no way

that you don't know the times and speed The

speed on the ticket will not be changed.

Probably a waste of time to fight it.

No excuse. He LIVES there, for god's sake, he is expected to know that he is within the school zone. If his argument is that he didn't know when it applies, he should NEVER drive over 20.
