Question:
Charged w/ Evading Arrest...They didn't try to arrest me???

Long story short: Girlfriend and I were arguing/yelling at each other in the front yard. (...I know, very Jerry Springer...) She flagged down a cop who was driving by. Cop makes a quick assessment of the situation, asks us for our identification and does the ol' "you stand over here, you stand over there". As he begins to run a warrant check, suddenly I remember a ticket that I hadn't taken care of!

Sure I had a warrant, and not wanting to go to jail, I start moving slowly toward my car (parked in the driveway). When he turned his back to me to talk to my girl, I jumped in the car & drove off! ***PLZ spare the lectures! I now know this was about the MOST IDIOTIC thing I could've done! I just panicked!***...And, in suitably fitting irony-I still had a few days to resolve the ticket & I DID NOT have a warrant ...BUT I GOT ONE!... for evading arrest!

Would i HAVE known if I was being :detained? I know MORALLY i deserve evading arrest, but strictly legally, is this "evading"?

Have you even bothered to read your states statute for evading arrest? In CO, you'd met the legal requirements...

It is evading, you left. The police did detain you. An arrest is not just going to jail. You can be arrested and never go to jail. I was arrested for driving while suspended, but released at the scene. Arrest means to detain. He detained you, you left. It is evading.
