Question:
Can you refuse a body cavity search?
?

eg: they stop you at the airport because they suspect something... can you say NO to a cavity search, or will they force you to do it? Cuz I would fight to the death. There is no way I am letting anyone do that to me when I'm innocent!
** I have not ever nor ever intend to smuggle anything. Just wondering if you have any rights **

The United State Supreme court has ruled that body cavity searches can only be conducted with the issuance of a search warrant (unless your in jail). This means the police will get probable cause for it then hold you until a search warrant from a judge can be obtained. Then they take you to a hospital and it is performed by a doctor under supervision by the police. While the body cavity search may not be done at the hospital, some airports to have an X-ray machine and a radiologist to X-ray you at the airport.

Yes.

A search is warranted only with good grounds.

A body cavity search has to be done by a doctor and is not a common search.

You still have civil rights. It takes a search warrant to do a body cavity search. They don't just pull people out of the crowd and do them. They have to have solid evidence that you have something hidden in your body and it has to be signed by a judge.

If they get the search warrant then yes..... you have to let them do it.

The theory of random body cavity searches in airports is the result of too many movies.

They don't do body cavity searches at the airport unless you're under arrest. Once arrested, it will happen whether you like it or not.

You can always refuse any level of searches, including the metal detector, but just be prepared to not use air transportation.

Most likely they will not do a "body cavity search" because that means stripping you down with no clothes on so NO. They will pat you down if you set off the metal detector. You can ask for a female to pat you down and they don't go into crotch

They use the metal detector wave it around your body. Do pass security checkpoints you have to submit but it is not a "Body cavity search".

@ reply #5: That's not true at all Even if you are arrested, you may still refuse unless there is a warrant in the cops hand. If there isn't, and you refuse to consent, if they do it anyway it is sexual assault and they can be indicted by a grand jury. There was a policewoman who was charged and sentenced to jail last year for doing that.

I went to the gyno today and when I seen her, I got quite wet. I began breathing hard and then she dropped her pen. I leaned to pick it up and my butt crack showed, and she smiled. We went back into the examination room and she put her hand right on up there and did a pap smear. I farted from shock and she giggled. She kept her hand in for another 3 hours. It was much more desirable than I anticipated.

If they have probable cause, they can obtain a search warrant and you'll have no choice... but, you'll probably be sedated and never know it.
