why cant i protect myself?

why is it that police are regular people with guns and when they are scared like regular people get, they have their shaky fingers on a trigger and they are allowed to shoot and say that it was out of self defense and they get to go on an eary vacation with pay but if we do anything with any kind of weapon to protect ourselves or our children, we get punished by the law.
to me, the police department/government is to the public what parents are to children so i am not against them and i understand we wont always like the decisions made for us and the laws we have to follow but why is it they can enforce the rules of the land but when we try to enforce the rules of our household, they again want to punish us, leaving many no choice but to let these rude and disrespectful children have complete reign in some households. i hear of children hitting their parents and cursing them out and stealing their parents' cars and i think some may deserve something harsher than punishment.

This is actually two very distinct questions. Your legal rights to apply deadly force within your home, on your property and out in public is determined in almost all cases by the laws of the state in which the event occurs. In Lousianna they have liberal self defense laws, remember the homewoner who shot and killed a foreign exchage student on Halloween on his property with a minimal warning. Perfectly legally, and repulsive to almost any reasonable person who read the case. Do this in California, and the gun owner will end up in state prison and have all assets seized under judgement (per california law limits) for these actions. Why, in California you can only use deadly force if their if no reasonable path to flee. You need to run away from the threat and escape instead of using deadly force. Police are given considerable leaway to use deadly force due to the danger in their job, which is fair and at the same time deadly to the public at times. Witness the answers from the cops in this question, arrogant to a person and dismissive of anyone who is not a right wing wingnut in one case, frightening. Liusten to me, I am a cop for seven years indeed, jerk.

As far as disciplining your child. You have every right to do whatever the law allows. You are responsble to raise the kids and need to only provide food, shelter and get to them school. If the kid does not tow the line, he loses all privlidges. If the kid does not respond, a thin mattress on a floor, decent meals with water served in his room, and one sets of clothes ogf your choice is all they get. Every other earthly possession is taken out of the room, period. No MP3, no TV, No dresser, no decorations, no clothes or shoes to pick from, no books or TV or gameboys or cellphones. Nothing but a mattress on the floor(air mattress will do) a thin blanket, sheets and one pillow in a pillow case. The one set of clothes gets dirty, too bad kid, wash em. Let the earn the other stuff back with good behavior, good deeds and good grades. Good luck

You are allowed to protect yourself. As long as you understand the rules of self defense and the defense of others you can effectively carry a weapon in comfort. Police get the same amount of scrutiny as private citizens when they are involved in a shooting. The difference is that the police are trained in the use and application of deadly force, where with private citizens we have to determine if their use of deadly force was within the law and justifiable. We know all about the trainng of the officers, but we do not know about the knowledge and training that any particular private citizen has, thus the intense investigation.

The police are not parental figures. We are not here to raise you and educate you in the ways of the world and common sense. (Though we find we have to occasionally.) We enforce the laws set by the society that we live in. We rely on parent and teachers to educate and discipline the children. If they are not up to the task the police are called in usually to mediate and find a solution to ease the tensions. If there is no middle ground to be found or the subjects are defiant then jail time may give the required wake up call.

As a police officer, I have laughed several times when called to a house because the child is upset they got disciplined. I tell them that they got into trouble, and their parents have every right to disciplne them, as they see fit, until a line is crossed. To me there is a line between discipline (spanking), and abuse (beating). I think we all need to thank the ACLU and other borderline domestic terrorrist groups for taking the rights out of parents hands and coddling and sheltering the youths of today. They need a strong parental presence in their lives, or MOST, a not all, grow up to be criminals. I know there are some laws that bind officers decisions in cases like this, but in my opinion, and they way I carry out my job is to let the parents raise their own children until they have shown that they are incapable. As far as weapons, you would go through the same process as we do when it comes to using force. When force is used, a grand jury decides if the act was justifed. So we don't get a free pass for using force, as you don't either. If it is found that or actions weren't justified, and that happens more than you think, we go to jail like any civilian would in the same circumstances.

You are allowed the Defense of Self-defense, but you cannot be excessive in your use of self-defense. You cannot shoot someone for trying to pull your hair, but you can shoot someone for trying to stab you etc.

The key to justifying the use of deadly force is whether or not you had a reasonable belief that your life was in danger. If you did, and you killed someone in self-defense, then you are off the hook. If you did not, and you kill someone, then generally speaking, you should be prosecuted for some type of homicide. Police have to follow the same rules.

(State self-defense laws may deviate slightly, I am talking about common law doctrine).

You CAN protect yourself, you have the right to own a gun here in the US. Here in Texas you have the right to transport it on the gun rack in back of your head in the pickup.

Just a few things you need to remember about protecting yourself. You can't shoot them until they are in the house, you can't shoot them if all they want is your TV, and for goodness sake, make them back up onto the linoleum because the police will not clean up the mess.

Well you are allowed to protect yourself and your families its just that different states have different laws on the subject. For instance in florida, they have to be inside of your house and you have to tell them you have a gun and then you can shoot. Texas they only have to be on your property and you have to tell them to get off your property. I would like if I never have to shoot anyone in my lifetime. My ex bro in law thinks its funny to harrass my sis and he has threatened our whole family. I wonder why he hasn't come over here? Oh yeah because he has been out hunting with my hubby and knows what we have in our house.

Great Question --- You get a Star.

For 13 years I had the most kind, respectful, generous, happy to go to school, involved at school, involved at the YMCA ---son. Everyone loved him.

I never had to do any more then raise the tone of my voice to him to get him to adjust his behavior.

At 13, all hell broke out.

He attempted to burn the house down by pouring kerosene throughout the house.

The Police blamed me.

(After intense therapy and medications)

At 15, he trashed my home. Broke lamps, the kitchen chairs, the computer and kicked my bedroom door in.

The Police told me to go to my room and leave him alone !!!!!

5 minutes later My 15 year old son Beat me. Hit me six times full fist in the face. (He benches 250lbs)

The police came again and asked IF I HAD BEEN DRINKING !!!!! (no)

They where going to have ME leave MY Home.

In order to have him removed from the home, for my safety, I had to place him into Social Services Custody.

I have written letters to the local law enforcement and local government. WITH NO RESULTS.

I even offered Donuts. Fat @ss Pigs any way !!!!

EDIT: Mule -- I have had a couple of Officers come to the house and where very helpful, but they have to answer to the Magistrates Office here.

So not offence to those in Uniform that are helpful, but for all the others --- They can KMA.

I think you need to sit back and read what you wrote.

Police are to uphold the law and protect citizens, not gun down anyone they want.

Parents who let their children become like that deserve to go to jail.

You have the right to bear arms and/or to participate in self-defense training. If you use it to defend yourself you should have nothing to worry about.

I have a feeling there's something you're not telling us...
